The mother of Aderrien Murry, the 11-year-old who was shot by an Indianola police officer on May 20, has signed a criminal affidavit in Sunflower County Justice Court against the officer.
Nakala Murry signed the affidavit today against IPD Sgt. Greg Capers, according to the family attorney, Carlos Moore of The Cochran Firm.
“According to the statute, a probable cause hearing should be held soon,” Moore told The Enterprise-Tocsin this evening.
In the affidavit, which Moore provided to The E-T, Nakala Moore states that Capers “did willfully and unlawfully caused bodily harm to my minor son Aderrien Murry by recklessly shooting him in the chest with a gun.”
Capers has not been formally charged or indicted, nor had an arrest warrant been issued for Capers as of press time.
Moore cited MS Code § 99-3-28 (2019) as it pertains to law enforcement officers, among others listed, who are accused of a crime in the fulfillment of their duty as the basis for this latest action.
Indianola City Attorney Kimberly Merchant declined to comment for this article, citing that this is an ongoing personnel matter.
The Mississippi Bureau of Investigation has been handling the case since the morning of the shooting.
Murry was shot apparently before dawn on that Saturday morning after calling 911 at request of his mother, who told us later that the father of her other child came to the home “irate.”
Police arrived, and at some point, officers ordered everyone out of the home with their hands up, according to Nakala Murry.
After she ran out, she said Aderrien Murry bolted for the front door running behind her, and that is allegedly when Capers shot him.
Aderrien Murry suffered a bullet wound to the chest. He was released from a Jackson hospital days later.
MBI was called in immediately to take over the officer-involved shooting investigation.
All body camera footage and other evidence was handed over to MBI that morning, according to the City of Indianola.
Moore and the family have consistently called for the release of the body camera footage from that day, the termination of Capers, as well as IPD Chief Ronald Sampson.
Moore is also representing the Murry family in a $5 million federal lawsuit that was filed against the City of Indianola, Capers, Sampson and others last week.
Capers is currently on suspension, with pay.
