The trial of Holly Ann McCraw Mitchell, which was scheduled to begin on Monday, has been continued again. Mitchell is charged with second-degree for the shooting death of her husband, Shawn Patrick “Chunk” Mitchell, on Jan. 4, 2019 at their home on Dale Street.
Police Chief Michael Kelly said at the time that Chunk Mitchell was shot with a handgun. However, other weapons, including an AR-15, were also found at the home.
Neighbors had reported that they could hear the couple arguing before the shooting.
Mitchell was indicted for second-degree murder on Aug. 3, 2020, with the trial originally set for Nov. 16, 2020.
The trial was continued the first time due to outstanding motions and also to give the defense more time to obtain additional counsel.
The agreed order of continuance was filed July 13 because the defense was not ready. Circuit Court Judge Clarence McDonald continued the case to Nov. 16.
On Wednesday, a hearing was held to determine the competency of Mitchell. It was ruled that Mitchell is competent and able to stand trial.
If Mitchell is found guilty, she could receive up to 20 years in prison.
Mitchell has been free on bond since Dec. 14, 2020. Her original bond was set for $540,000, but was reduced to $505,000.
